ADAMS, P. J.
Defendant was charged by information with the crime of murder of the first degree. He pleaded not guilty and not guilty by reason of insanity. The jury found him guilty of murder in the second degree and fixed his punishment at imprisonment for life, and he was committed to the state prison. This appeal is from the judgment and from the order denying his motion for a new trial.
[1] He complains because the court permitted the district attorney to use the following comment in his argument to the jury: "And I don't think there is any evidence in the record in this case to show he was sane at the time of the commission of the crime."
The complaint is entirely without merit, for the record discloses that defendant's counsel made no objection to the argument. It follows that the point is not available for review. (People v. Fleming, 12 Cal.App.2d 253, 255 [55 P.2d 831].)
[2] The court gave the jury the usual instruction with reference to the responsibility of a person who is insane. Thereafter, on the 13th day of the trial, defendant requested the court to give an instruction to the effect that the defendant was not required to prove his insanity and that the jury should *420 presume that he was sane, and that the burden was on the prosecution to prove that he was sane beyond a reasonable doubt.
